SWEEPSTAKES PERIOD: The Cavit Freebie Fridays Giveaway Sweepstakes (the “Sweepstakes”) will run during the following days in June: June 3, 2022 from 12:01 a.m. Pacific Standard Time (“PST”) to 11:59 p.m. PST; June 10, 2022 from 12:01 a.m. PST to 11:59 p.m. PST; June 17, 2022 from 12:01a.m to 11:59 p.m. PS, and June 24, 2022 from 12:01 a.m. to11:59 p. m. PST (each a “Sweepstakes Period”). The Sponsor’s computer or that of its designee is the official timekeeper for this Sweepstakes.
ELIGIBILITY: Sweepstakes is open to all legal residents of the fifty (50) United States and the District of Columbia, 21 years of age or older as of date of entry. Employees of Palm Bay International, Inc./Cavit (“Sponsor”), their subsidiaries, distributors, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Participation in the Sweepstakes per account is only eligible once a day during the Sweepstakes period. If you have received a prize from Sponsor within the past six (6) months in connection with another Sponsor promotion, you are not eligible to participate in this Sweepstakes or receive a prize. Void where prohibited by law. Sweepstakes is subject to all applicable federal, state, and local laws. The Sweepstakes is void outside the fifty (50) United States and the District of Columbia and where prohibited by law. This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Instagram. You understand that you are providing your information to Sponsor and not to Instagram.
HOW TO ENTER:
1. How to Enter: Online entries must have an Instagram account, which is free. An Instagram account can be obtained by going to www.instagram.com and entering information in the ‘Sign Up’ form on the first page. Instagram, located at www.instagram.com, is not affiliated with and does not endorse or sponsor the Sweepstakes and is not subject to Sponsor’s Privacy Policy. Instagram accounts are governed by the Instagram privacy policy (https://www.instagram.com/about/legal/privacy/). Once entrant has obtained an Instagram account, Entrant can go to https://www.instagram.com/cavitwines (the “Sweepstakes Site”) at any time during each of the Sweepstakes Period to enter for a chance to win one of the prizes. In order to participate, each entrant must do the following: (a) INSTAGRAM: visit and follow the Cavit (USA) Instagram Feed @cavitwines at https://www.instagram.com/cavitwines. (b) Like the weekly Sweepstakes post and comment on the Sweepstakes post @tagging a friend. Each entry will be deemed to have been submitted by the natural person assigned to the Instagram account associated with the entry. No software-generated, robotic, programmed, script, macro or other automated online or text message entries are permitted. Or (c) if entrant would like to enter the sweepstakes without following, liking, or tagging someone on the Instagram post, the entrant may enter by clicking on the link that would appear on the bio of the page and the Entrant will be directed to the sweepstakes website at https://www.cavit.com/contact/ (the “Entry Site”), which is the only entry website that entrant can validly enter the sweepstakes at. Once in the Entry Site, the entrant will follow the directions for “contact form” (providing your name, address, telephone number, date of birth and (if applicable) your email address [“Online Entry”]).
RANDOM DRAWING & PRIZE:
At the end of each Entry Period (four (4) Fridays during the month of June), ten (10) lucky winners will be selected in a random drawing from among all eligible entries received throughout that Friday to win a prize. At the end of the Cavit Freebie Fridays Giveaway Sweepstakes, there will be a total of forty (40) grand prize winners selected.
Weekly winner prizes will include the following: (total Approximate Retail Value (“ARV”) of all prizes weeks 1-3 approximately $50; week 4 approximately $100.
Week 1 (June 3): One pair of “Better Together” Cavit branded pool noodles
Week 2 (June 10): One set of “Better Together” Cavit branded playing cards and wood block stacking game
Week 3 (June 17): One pair of “Better Together” Cavit branded wine tumblers
Week 4 (June 18): One set of “Better Together” Cavit branded Cornhole, playing cards and frisbee
WINNER NOTIFICATION: The potential winners will be notified via direct message on Instagram and are required to respond within 48 hours of time of direct message notification. If the potential winner does not respond, Sponsor is unable to contact a potential winner or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected. Sponsor’s decisions are final and binding on all matters relating to this Sweepstakes.
PRIZE CONDITIONS: Valid only in the U.S.A. and are void where prohibited. All federal, state, and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner. Winners may not substitute, assign, or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge and hold harmless Sponsor, Likeable Media, Facebook, Instagram, their affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity or the acceptance, possession, use or misuse of any awarded prize; and (c) to the use of his/her name, voice, performance, photo, image, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. By participating, entrants also agree not to release any publicity or other materials on their own or through someone else regarding their participation in the Sweepstakes without the prior consent of the Sponsor, which it may withhold in its sole discretion. By participating each entrant agrees to release, discharge, and hold harmless the Released Parties from any claim made for prizes lost or otherwise lost or damaged in transit. IN ADDITION, NO IMPLIED OR EXPRESS WARRANTY FOR PRIZES IS GIVEN.
MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Entries or codes, or for lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, photos, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes (or portion thereof) and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the Commonwealth of New York, USA.
